Australia's national workplace tribunal, and the first major tribunal to require people to disclose their use of AI in filings.
The Fair Work Commission is Australia’s national workplace relations tribunal. It handles unfair dismissal claims, disputes over pay and conditions, and similar matters, and it is designed so that ordinary people can bring a case without a lawyer.
That design is why it ran into generative AI early. A report it commissioned found its caseload grew about 40 percent between 2023-24 and 2024-25, partly because chatbots made filing a claim feel possible, and that roughly 40 percent of surveyed cases involved a litigant using AI. In August 2026 it ordered a self represented applicant to pay part of his employer’s legal costs after he relied on AI as a “quasi legal advisor” in a hopeless case, and announced that from 20 October 2026 applicants must disclose any AI use and verify the facts, authorities and links it produced.
